However, an exclusion clause will be valid, when it is contained within the contract. And a claim cannot be made that the plaintiff had not read the exclusion contract, as was established in the case of L'Estrange v Graucob [1934] 2 KB 394. In this case, the written contract was signed by the parties and hence, the exclusion clause was deemed as a part of the contract (Swarb, 2017). Application In this case, Elizabeth owed a duty of care towards the people visiting her restaurant. Elizabeth failed in making the floor anti-slippery. Since Lesley slipped on the slippery floor, and broke her legs, she was significantly injured. There was a direct causation between the floor being slippery, and the fall of Lesley. I am a person who can identify with these, in starting school a few years back I was very intimidated and self conscious about being in a class room with people I did not know. At first in my class I did not perform very well with the group, but as I got to know everyone my positivity started coming out and I was able to benefit with being in a group and excelled. At about a week to his final exams, he overheard some of his friend discussing about a man called scoopy who is an expert in sending malpractices’ to one during exams via mobile phone..Dongosu was happy to hear this, he collected all information needed about scoopy and he went to meet him concerning his final exams. Scoopy promised to send him the answers during the exam and they both agreed on the amount of money scoopy would collect. During the exam Dongosu would receive the answers as a text message and he would copy it into his exam booklet.After the exams, Dongosu boasted to everyone that his result would be the best in the state, he also told his parent he would like to throw up a party on the day the result would be out. His father called him and told him to be patient till when the result comes out. Life comes full circle in every life represented and follows in the steps of the previous generation. Elizabeth Long Crawford meets the destiny of a partially blind person when she is a young girl. Having her hopes dashed at a happy future, Elizabeth settles with a husband and has children, but both of these aspects in her life become unsatisfactory to her. Her husband dies, her son is average in her eyes, and her daughter Martha becomes the subject of constant criticism. As Martha moves on after the death of her mother, she realizes that although she wants nothing to do with her mother, she wishes she was closer to her relatives, so she organizes a family reunion. This brings about something Martha never expected. The repetitious rise and fall of hope and despair that engulfs Martha’s life takes her on the endless human journey to happiness and fulfillment. She is so distraught in the failures of her life that she finds imperfections in other aspects of her life so as to blame those imperfections for her dissatisfying life. Definition and Examples of Contact Languages A contact language is a marginal language (a type of lingua franca) used for purposes of basic communication by people with no common language. English as lingua franca (ELF), says Alan Firth, is a contact language between persons who share neither a common native tongue nor a common (national) culture, and for whom English is the chosen foreign language of communication (1996). Examples and Observations Ancient Greek around the Mediterranean basin, or later Latin throughout the Roman Empire, were both contact languages. They tend to vary in use in different local contexts, and there is often a great deal of local language interference. Latin, for example, later developed many local forms which eventually became French, Italian, Spanish, Portuguese, and so on.
